Terms & Conditions
Effective Date: September 13, 2026
Last Updated: September 13, 2026
These Terms & Conditions ("Terms") govern your use of the SnapVista website (snapvista.ca) and the photography services provided by SnapVista ("SnapVista," "we," "us," or "our").
By accessing our website, submitting an inquiry, booking a photography session, purchasing a service, or otherwise engaging our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.
1. About SnapVista
SnapVista provides professional photography services, including but not limited to maternity, newborn, family, couples, portrait, lifestyle, event, and other photography services.
Specific services, pricing, deliverables, session details, and other arrangements may be confirmed separately through a quotation, booking confirmation, service agreement, invoice, or other written communication.
2. Photography Bookings
A photography session is considered booked only after SnapVista has confirmed the booking and any required booking fee, deposit, or retainer has been received.
Availability is not guaranteed until the booking has been confirmed by SnapVista.
Booking details may include the agreed date, time, location, photography package, deliverables, pricing, and any special requirements.
Clients are responsible for reviewing their booking details carefully and notifying SnapVista promptly if any information is incorrect.
3. Pricing and Payments
Prices for photography services will be communicated through our website, quotations, packages, invoices, or direct communication with the client.
Unless otherwise stated, all prices are in Canadian dollars (CAD) and may be subject to applicable taxes.
A deposit, retainer, or full payment may be required to confirm a booking. The applicable payment requirements will be communicated before or at the time of booking.
The remaining balance, where applicable, must be paid according to the payment schedule provided by SnapVista.
SnapVista reserves the right to withhold delivery of final photographs or other deliverables until all outstanding amounts have been paid.
4. Deposits and Retainers
Where a deposit or retainer is required, it reserves the agreed session date and time for the client.
Unless otherwise agreed in writing or required by applicable law, deposits and retainers may be non-refundable because SnapVista may decline other bookings for the reserved date and allocate resources to the session.
Any refund eligibility will be determined according to the applicable booking agreement and these Terms.
5. Cancellation by the Client
If you need to cancel a photography session, please notify SnapVista as soon as reasonably possible.
Cancellation fees, forfeiture of deposits or retainers, and refund eligibility may depend on how much notice is provided and the terms of the applicable booking.
If no separate cancellation policy has been provided, SnapVista may retain any non-refundable booking fee or retainer to compensate for the reserved date, preparation, administration, and potential loss of other bookings.
6. Rescheduling
Clients may request to reschedule a session by contacting SnapVista as early as possible.
Rescheduling is subject to availability and is not guaranteed.
SnapVista may limit the number of times a session can be rescheduled or may apply additional fees where significant preparation, travel, venue costs, or other expenses are involved.
Any rescheduling arrangements will be confirmed by SnapVista in writing.
7. Late Arrival
Clients are responsible for arriving at the agreed location on time.
Late arrival may reduce the amount of time available for photography and may affect the number of photographs or poses that can be captured.
Unless otherwise agreed, the original session end time may still apply even if the client arrives late.
Additional charges may apply if a significant delay requires SnapVista to extend the session or incur additional costs.
8. Client Responsibilities
Clients are responsible for providing accurate information and cooperating reasonably with SnapVista before and during the photography session.
Clients should:
- Provide accurate booking and contact information.
- Arrive at the agreed location on time.
- Inform SnapVista of relevant session requirements in advance.
- Obtain permission to photograph any venue or location where required.
- Ensure children and other participants are appropriately supervised.
- Follow reasonable instructions given by the photographer.
- Inform SnapVista of any relevant accessibility or logistical requirements.
- Treat SnapVista staff, contractors, and representatives respectfully.
9. Outdoor Sessions and Weather
Outdoor photography sessions may be affected by weather, environmental conditions, venue restrictions, emergencies, or other circumstances outside SnapVista's control.
Where weather or other conditions make an outdoor session impractical or unsafe, SnapVista may recommend rescheduling, changing the location, or modifying the session.
Rescheduling due to weather will be handled based on availability and the specific circumstances of the booking.
10. Photographer Illness or Unavailability
SnapVista will make reasonable efforts to fulfill confirmed bookings.
However, circumstances such as serious illness, injury, equipment failure, emergency, accident, venue closure, severe weather, or other circumstances beyond our reasonable control may prevent a session from taking place.
Where reasonably possible, SnapVista may offer an alternative photographer, reschedule the session, or provide another appropriate solution.
If SnapVista is unable to provide the service and no suitable alternative can be arranged, any refund will be handled in accordance with the applicable booking agreement and applicable law.
11. Photography Style
By booking SnapVista, clients acknowledge that photography involves artistic judgment and creative interpretation.
Clients may review SnapVista's portfolio and existing work before booking and should consider the photographer's style when making their booking decision.
While SnapVista will make reasonable efforts to accommodate agreed preferences, specific poses, expressions, lighting conditions, backgrounds, weather, photographic compositions, or exact images cannot be guaranteed.
12. Image Selection and Editing
SnapVista retains artistic discretion regarding image selection, editing, colour grading, cropping, retouching, and final presentation unless otherwise agreed in writing.
Not every photograph taken during a session will necessarily be delivered to the client.
Test shots, duplicate images, technically unusable images, outtakes, unedited images, and rejected images are generally not included in the final delivery.
RAW or unedited files are not normally provided unless specifically agreed in writing.
13. Delivery of Photographs
Final photographs will be delivered using the method communicated by SnapVista, which may include an online gallery, digital download, cloud-based delivery, or another agreed method.
Estimated delivery times may vary depending on the type and volume of the photography session, editing requirements, seasonal demand, and other factors.
Unless a guaranteed delivery date has been agreed in writing, any stated delivery timeframe is an estimate.
14. Client Image Storage
Clients are responsible for downloading and safely backing up their delivered photographs.
SnapVista may retain photographs for a limited period after delivery but does not guarantee indefinite storage or availability of client files.
Clients should maintain their own backup copies of delivered photographs.
15. Copyright and Ownership
Unless otherwise agreed in writing, copyright and other intellectual property rights in photographs created by SnapVista remain with SnapVista or the applicable rights holder to the extent permitted by law.
Purchasing photography services or receiving digital photographs does not automatically transfer copyright ownership to the client.
Clients receive a personal-use licence for the delivered photographs unless a different licence or usage arrangement has been agreed in writing.
16. Personal Use of Photographs
Unless otherwise specified, clients may use delivered photographs for personal, non-commercial purposes, including sharing with family and friends and posting on personal social media accounts.
Clients may not sell, license, commercially reproduce, substantially alter, or otherwise commercially exploit the photographs without prior written permission from SnapVista.
Clients should not apply filters or edits that materially alter the intended artistic presentation of the photographs where such use could reasonably imply that the modified work was created or approved by SnapVista.
17. Commercial Use
Commercial use of photographs, including use in advertising, business websites, product packaging, publications, promotional campaigns, or other commercial activities, may require a separate commercial licence.
Please contact SnapVista if you require commercial usage rights.
18. Portfolio and Promotional Use
SnapVista may wish to display selected photographs in its portfolio, website, social media accounts, advertising, promotional materials, competitions, exhibitions, or other marketing channels.
Where required, such use will be subject to the applicable client agreement, image-use consent, model release, or other permission.
If you have specific restrictions regarding the public use of photographs, please discuss them with SnapVista before your session and ensure that any agreed restrictions are documented in writing.
19. Locations and Venue Permissions
Clients are responsible for obtaining any required permission, permit, booking, access authorization, or other approval necessary to conduct photography at a private property, venue, public location, park, or other restricted location.
Any venue fees, permits, admission fees, parking fees, travel expenses, or other location-related costs that are not included in the agreed package may be the client's responsibility.
20. Travel and Additional Expenses
Additional travel charges or expenses may apply for locations outside SnapVista's standard service area.
Any applicable travel fees, accommodation costs, parking charges, permits, venue fees, or other agreed expenses will be communicated to the client where applicable.
21. Safety
The safety of clients, children, guests, photographers, assistants, and other participants is important to SnapVista.
SnapVista may refuse or discontinue a photography activity if it reasonably believes that the activity presents an unacceptable safety risk.
Clients remain responsible for their own safety and for the supervision of children and other individuals under their care.

23. Intellectual Property on the Website
Unless otherwise indicated, the website and its content, including photographs, images, logos, graphics, text, branding, design elements, videos, and other materials, are owned by or licensed to SnapVista and are protected by applicable intellectual property laws.

This may include loss of data, loss of business, loss of profits, or other consequential losses, except where such limitation is prohibited by law.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
27. Force Majeure
SnapVista will not be responsible for failure or delay in performing its obligations where the failure or delay results from circumstances beyond its reasonable control.
Such circumstances may include natural disasters, severe weather, fire, flood, power outages, equipment failure, government restrictions, public emergencies, illness, accidents, transportation disruptions, venue closures, or other unforeseen events.
28. Changes to Services or Pricing
SnapVista may modify its services, packages, pricing, website content, or availability from time to time.
Changes will not affect a confirmed booking where a different arrangement has already been agreed in writing, except where changes are necessary due to circumstances beyond SnapVista's reasonable control.
29. Changes to These Terms
SnapVista may update these Terms from time to time to reflect changes in our services, business practices, technology, or legal requirements.
The updated Terms will be published on this page with a revised "Last Updated" date.
Your continued use of the website or booking of services after changes are published constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
30. Governing Law
These Terms will be governed by and interpreted in accordance with the laws applicable in the jurisdiction where SnapVista operates, without regard to conflict-of-law principles.
Any disputes will be subject to the applicable courts and legal jurisdiction, except where applicable law provides otherwise.
31. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or removed to the extent necessary, and the remaining provisions will continue in effect.
32. Entire Agreement
These Terms, together with any applicable booking agreement, quotation, invoice, service agreement, or other written terms provided by SnapVista, constitute the agreement governing the relevant services.
If there is a conflict between these Terms and a specific written booking or service agreement, the specific written agreement will generally govern the relevant booking to the extent of the conflict.
